Britney Spears' restraining order against Sam Lutfi remains in effect

(CNN) A temporary restraining order against Britney Spears' former friend Sam Lutfi, remains in effect, for now.

Earlier this month, Spears was granted a temporary restraining order against Lutfi, a former member of her inner circle, who also claimed to be her manager -- although her representatives have told CNN that was never the case.

A hearing in which Lutfi was attempting to get the restraining order lifted was suspended on Tuesday.

Lutfi contends the order is"unconstitutional."

A new hearing has been set for next month, where a judge will determine whether to extend the order or end it.

Under the current order, Lutfi must stay at least 200 yards away from the singer and is not to make "disparaging public statements" about Spears, her family, her conservator or her current manager.

The star's parents, James and Lynne Spears and her sons, Sean and Jayden, are also listed as "additional protected persons" in the order.

In court documents obtained by CNN, Lutfi admits to contacting Spears' mother via text message and phone calls, although he claims this was not harassing behavior and that he was simply concerned for Spears after she checked into a mental health facility and suspended upcoming performances.

He also claims that Spears' mother never told him to stop contacting them.

Spears' 81-page filing earlier this month states that over a decade ago, Lutfi used Spears to "gain attention' and kept her "isolated."

"Beginning over a decade ago, Lutfi began pretending to have a professional association with Ms. Spears, even falsely claiming to have been her manager, when in reality he was only a parasite attempting to gain attention by associating himself with her celebrity and attempting to keep her isolated and under his influence," the filing stated. "Only through the intervention of the conservatorship years ago (and obtaining a temporary restraining order) was he effectively extracted from her life and her well being restored."

CNN has reached out to Spears and Lutfi's representatives for comment.
